Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern access to Spotogram at https://spotogram.app (the "Service"), operated by Spotogram from Bosnia and Herzegovina ("we", "us", or "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Spotogram is a studio for radio commercials. You write or generate a script, pick a voice and bed, mix the spot, and export audio intended for broadcast.

We may change or discontinue features. We do not promise that a station will accept or air any spot you export. The Service is provided as is, without an uptime guarantee.

Voice-over is produced through our audio production systems and contracted processors. We do not list every production vendor by name.

3. Accounts

You must be at least 18 to register. One person, one account.

  • Give accurate information and keep it current.
  • Keep your password secret. You are responsible for activity on the account.
  • Do not share login credentials.
  • Tell us at support@spotogram.app if you think the account was compromised.

4. Your content

You own the scripts, briefs, client records, uploaded music, and finished spots you create. We need a limited licence to host, generate, mix, store, and export that material so the studio can work. We do not use your spots to advertise Spotogram, and we do not sell your copy.

You are responsible for what you put in a spot: claims, prices, phone numbers, music you upload, and any brand you mention. Do not submit content that infringes someone else's rights.

Beds from our library are licensed for inclusion in spots you export from the Service. You may not extract, resell, or redistribute those tracks as standalone music.

5. Prohibited use

You may not use the Service to:

  • Break the law or make spots that are illegal to broadcast
  • Post harmful, violent, hateful, harassing, or adult content
  • Infringe copyright, trademarks, or other IP
  • Spam, scrape, or attack the Service with bots or malware
  • Resell access or share an account

We may suspend or close an account that breaks these rules.

6. Payment

Paid access is sold as a subscription and optional character top-ups. Checkout, invoices, tax, and card handling are done by Polar, our merchant of record. We do not store card numbers.

Prices are shown at checkout. Polar may display EUR, BAM, or another enabled currency based on the buyer. Subscriptions renew automatically until you cancel in the Polar portal (Billing → Manage subscription).

Characters are consumed when you generate voice. Mix and export are not billed as characters. Consumed characters are not refundable. Payments are otherwise final, except where Polar's checkout terms or mandatory consumer law say otherwise.

7. Our intellectual property

The Service, the Spotogram name, the interface, and our licensed music library remain ours or our licensors'. These Terms do not transfer that ownership to you.

8. Disclaimer

The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or fit for a particular campaign or station. You decide whether a spot is ready to air.

9. Limitation of liability

To the fullest extent allowed by law, Spotogram and its contractors are not liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill, arising from your use of the Service, third-party content, or unauthorized access to your account.

Nothing in these Terms limits liability that cannot be limited under the law of Bosnia and Herzegovina, or mandatory rights of consumers where those rights apply.

10. Indemnity

You will defend and indemnify Spotogram against claims that arise from your spots, your uploaded files, or your breach of these Terms, including claims that an ad infringes a third party's rights.

11. Termination

You may stop using the Service and cancel billing in the Polar portal. We may suspend or close an account for breach of these Terms. After closure, your right to use the studio ends. We handle remaining data as described in the Privacy Policy.

12. Governing law

These Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict-of-law rules. Courts in Bosnia and Herzegovina have jurisdiction, except where mandatory consumer rules give you another forum.

13. Changes

We may update these Terms. The new version is effective when posted on this page, with a new "Last updated" date. If a change is material, we will try to give reasonable notice. Continued use after the change means you accept the new Terms.
